{"id":617,"date":"2020-03-25T15:14:09","date_gmt":"2020-03-25T15:14:09","guid":{"rendered":"http:\/\/tierra.jerrejerre.com\/es\/?p=617"},"modified":"2021-05-13T21:34:46","modified_gmt":"2021-05-13T21:34:46","slug":"la-toma-mas-que-un-nombre-un-presagio","status":"publish","type":"post","link":"https:\/\/tierraderesistentes.com\/en\/2020\/03\/25\/la-toma-mas-que-un-nombre-un-presagio\/","title":{"rendered":"La Toma: not just a name, but an omen"},"content":{"rendered":"\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201cThey arrived with the name Kedahda and as they couldn\u00b4t find room, they then appeared as AngloGold Ashanti and immediately began to invest in building a little road, and in giving incentives&#8221;.<\/p><cite>Isidoro Lucum\u00ed<\/cite><\/blockquote>\n\n\n\n<p>Isidoro Lucum\u00ed was one of the first employees of the multinational in La Toma. \u201cThey arrived with the name Kedahda and as they couldn\u00b4t find room, they then appeared as AngloGold Ashanti and immediately began to invest in building a little road, and in giving incentives. <strong>One day I said to the head geologist, \u2018Why are we investing so much time in this area?\u2019 He answered, \u2018La Toma is sitting on top of gold; that\u00b4s why it is so sought after.\u2019\u201d<\/strong><\/p>\n\n\n\n<p>Members of the community recall excessive kindness from the company in these early days. They gave tools to the farmers, donated books to the children at the start of the school term, bought footballs and kits for those who liked to play, and donated instruments to local music groups.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>&#8220;others amongst thought that, \u2018Nothing comes for free; they must have an ulterior motive.\u2019 And there was already talk of a mining project, so we listened to our elders and we said \u2018No\u2019 to AngloGold\u201d<\/p><cite>Francia M\u00e1rquez<\/cite><\/blockquote>\n\n\n\n<p>\u201cSome said of them, \u2018These people seem like they like progress,\u2019 but others amongst thought that, \u2018Nothing comes for free; they must have an ulterior motive.\u2019 And there was already talk of a mining project, so we listened to our elders and we said \u2018No\u2019 to AngloGold\u201d, points out Francia M\u00e1rquez, <strong>a woman who has dedicated her entire life to ancestral mining and who led the fight against illegal mining on her land. For these efforts, for which she risked her life, she was <a href=\"https:\/\/www.goldmanprize.org\/recipient\/francia-marquez\/\">awarded<\/a> the Goldman Environmental Prize, considered the green Nobel, in 2018.<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image alignfull size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"2560\" height=\"1707\" src=\"https:\/\/tierra.jerre-dev.xyz\/wp-content\/uploads\/2020\/03\/42-scaled.jpg\" alt=\"\" class=\"wp-image-4958\" srcset=\"https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211132\/42-scaled.jpg 2560w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211132\/42-300x200.jpg 300w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211132\/42-1024x683.jpg 1024w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211132\/42-768x512.jpg 768w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211132\/42-1536x1024.jpg 1536w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211132\/42-2048x1365.jpg 2048w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211132\/42-150x100.jpg 150w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211132\/42-696x464.jpg 696w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211132\/42-1068x712.jpg 1068w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211132\/42-1920x1280.jpg 1920w\" sizes=\"auto, (max-width: 2560px) 100vw, 2560px\" \/><\/figure>\n\n\n\n<p>Relations with AngloGold Ashanti, the world\u00b4s third largest gold <a href=\"https:\/\/www.las2orillas.co\/los-lunares-de-anglogold-ashanti\/\">producer<\/a>, ended terribly. <strong>In the midst of this fight to hold onto their territory, say members of the community council, the first leaflets threatening their leaders arrived.<\/strong><\/p>\n\n\n\n<p><strong>The threats came from alleged paramilitary groups.<\/strong> In order to plant fear in the region the <span style=\"background-color:#374141\" class=\"td_text_highlight_marker\">Calima Block<\/span> of the <span style=\"background-color:#374141\" class=\"td_text_highlight_marker\">United Self-Defence Forces of Colombia (AUC)<\/span> committed 119 massacres between 1999 and 2004, according to the National Centre of Historic Memory. The fear was latent.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u2018Let them kill me here because I\u00b4m not leaving La Toma again\u2019<\/p><\/blockquote>\n\n\n\n<p>Only three years earlier, the Calima Block had executed a <a href=\"https:\/\/verdadabierta.com\/los-origenes-de-la-masacre-de-el-naya\/\">massacre<\/a> in the nearby coastal region of El Naya, in which they murdered more than 30 people, on their return from Timba (Cauca) to the Pacific Ocean left a trail of death through the municipality of Su\u00e1rez.<\/p>\n\n\n\n<p>\u201cIt was very difficult for us when these threats arrived, giving our friends a week to get out of the area. <strong>When they arrived in the city, with no idea what to do there, they couldn\u00b4t take it, and after two months they came back.<\/strong> They said, \u2018Let them kill me here because I\u00b4m not leaving La Toma again,\u2019\u201d M\u00e1rquez remembers of that time.<\/p>\n\n\n\n<figure><iframe loading=\"lazy\" width=\"480\" height=\"270\" src=\"https:\/\/www.youtube.com\/embed\/VyeH2jzDLbo?feature=oembed\" allowfullscreen=\"\"><\/iframe><\/figure>\n\n\n\n<p>There were days which those of the community, whose culture is expressed at the rhythm of traditional, folkloric rhythms such as <em>chirim\u00edas<\/em>, <em>torbellinos<\/em> and <em>fugas<\/em> and the encompassing sounds of violins and drums, were locked in silence. The streets of the hamlet at the top of the mountain, where every morning at dawn people rose playing in the dew, were deserted. The recommendation was that each home had a cellphone with at least one minute of credit so that they could warn of any strange movements. <strong>Everyone was on full alert.<\/strong><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>&#8220;the community detains them and they have to explain down to the last detail what they came to do there&#8221;.<\/p><cite>Jairo Char\u00e1<\/cite><\/blockquote>\n\n\n\n<p>Jairo Char\u00e1, coordinator of the local traditional mining committee, <strong>who survived an attack in his home on December 6th, 2006<\/strong>, in the middle of the territorial dispute with AngloGold, recalls how his community organized themselves to self-protect. \u201cFrom then on, anyone who enters La Toma has to say where they come from and what their intentions are. If they have no obvious reason for being there, the community detains them and they have to explain down to the last detail what they came to do there,\u201d he says.<\/p>\n\n\n\n<p>But La Toma had not yet managed to contain the interests in gold mining when they had to take on another fight. Not for all the money in the world will we let this river be moved.&#8221;.<\/p><\/blockquote>\n\n\n\n<p>\u201cThe people said, \u2018The Ovejas River is our life, it\u00b4s our dignity, and that doesn\u00b4t have a price. That river had sustained them, and therefore they were very sensitive to anything regarding the reservoir at Salvajina, constructed to generate 270,000 kilowatts of electricity.<\/p>\n\n\n\n<p>This concrete and iron structure <strong>completely altered the flow of the Cauca River over a distance of 31 kilometers, and it raised the water level by more than 100 cubic meters over the ancestral lands of the Afro-Colombians of La Toma.<\/strong> Their lands, crops, the best mines and a good part of their traditions were left submerged under 849 million cubic metres of water.<\/p>\n\n\n\n<figure><iframe loading=\"lazy\" width=\"480\" height=\"270\" src=\"https:\/\/www.youtube.com\/embed\/StuY7GP6DFc?feature=oembed\" allowfullscreen=\"\"><\/iframe><\/figure>\n\n\n\n<p>For Mayor Isidoro Lucum\u00ed, the memory of the impotence that people felt when they were removed from their lands remains fresh, and is today described as a false illusion they had of progress in their community.<\/p>\n\n\n\n<p>&nbsp;\u201cWhen these people arrived they caught us with our eyes closed. An engineer told us, \u2018You have a lot and it is worth a lot.\u2019 I had a plot of 9,720 square meters and they paid me $300.006 pesos and I asked the engineer, \u2018And these extra six pesos, what are they for? Where did they come from?\u2019 <strong>His reply was, \u2018You can take them or leave them. If you don\u00b4t, they\u00b4ll be deposited in a bank and then we\u00b4ll see how you take them.\u2019 This was total humiliation. This is why we don\u00b4t want any more multi-nationals here,\u201d<\/strong> says Isidoro.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>&#8220;I had a plot of 9,720 square meters and they paid me $300.006 pesos&#8221;.<\/p><cite>Isidoro Lucum\u00ed<\/cite><\/blockquote>\n\n\n\n<p>The elders of the community <strong>assert that with the reservoir they were promised that because it was the biggest infrastructure project being carried out in Southwest Colombia at the time, it would bring tourism, roads, schools, health and all round better quality of life. <\/strong>This promise also turned to dust. The energy is miniscule and the people earning the lowest income receive monthly bills of 300,000 to 400,000 pesos (US $100-130). <strong>We also have this lake, but my community doesn\u00b4t have clean drinking water. Do people have to wait until it rains to drink water?\u201d <\/strong>asks M\u00e1rquez.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>&#8220;Instead, what Salvajina left was misery for my community&#8221;<\/p><cite>Francia M\u00e1rquez<\/cite><\/blockquote>\n\n\n\n<p><strong>The construction of Salvajina required the displacement of more than 6,000 people. <\/strong>The municipality of Su\u00e1rez went from 23,500 inhabitants in 1993 to 18,000 in 2006, according to the Black Communities Process (PCN), one of the most active Afro-Colombian community organizations at the national level.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Ovejas River Once Again<\/strong><\/h2>\n\n\n\n<p>Their dignified resistance, preventing the splitting of the mountain to divert the Ovejas River and holding off the arrival of AngloGold Ashanti from their territory, still were not enough to deter foreign interests from their land. <strong>The worst was still to come, and this time it was under the name of illegal mining.<\/strong><\/p>\n\n\n\n<p>Beginning in 2004 \u2013 the community recalls \u2013 there were skirmishes with <strong>people who tried to enter the river to search for gold, but they always managed to remove them from the lands.<\/strong> However, this siege of outsiders, usually arriving from eastern Antioquia and Choc\u00f3, was becoming more and more intense <strong>until in 2010 it reached a point that was the worst period they remember.<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image alignfull size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"2560\" height=\"1701\" src=\"https:\/\/tierra.jerre-dev.xyz\/wp-content\/uploads\/2020\/03\/33-scaled.jpg\" alt=\"\" class=\"wp-image-4956\" srcset=\"https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211140\/33-scaled.jpg 2560w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211140\/33-300x199.jpg 300w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211140\/33-1024x680.jpg 1024w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211140\/33-768x510.jpg 768w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211140\/33-1536x1020.jpg 1536w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211140\/33-2048x1361.jpg 2048w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211140\/33-150x100.jpg 150w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211140\/33-696x462.jpg 696w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211140\/33-1068x710.jpg 1068w, https:\/\/media.tierraderesistentes.com\/wp-content\/uploads\/2020\/03\/19211140\/33-1920x1276.jpg 1920w\" sizes=\"auto, (max-width: 2560px) 100vw, 2560px\" \/><\/figure>\n\n\n\n<p><strong>Threats against environmental leaders from criminal bands known as The Black Eagles, New Generation and The Stubble saw a surge after the demobilization of the paramilitaries, and continued to increase up until August of 2009.<\/strong> Anxiety converted into pure fear after the 7th of April 2010, when armed men assassinated eight miners on the banks of the Ovejas River, in La Toma\u2019s backyard.&nbsp;<\/p>\n\n\n\n<p>As a result, those who arrive in the municipality of Su\u00e1rez, located more than an hour from Cali, find a painting that seems to belong to the wrong exhibition. What appears from afar to be a bunker which from a lost diplomatic mission, is in fact a humble house at the dusty entrance to the town, furnished only with a plastic table and various white plastic seats, which serves as the meeting site for the Association of Community Councils for Northern Cauca (ACONC).<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>&#8220;They knew we were not in accordance with this destruction they were causing and from this new threats were invented against us for \u2018opposing development'&#8221;<\/p><cite>An\u00edbal Vega<\/cite><\/blockquote>\n\n\n\n<p>Inside the house <strong>a handful of leaders discuss the issues that affect them on a daily basis, while outside a convoy of the newest model Toyota trucks waits for them \u2013 armed and with a small army of armed men from the National Protection Unit<\/strong>, the governmental agency which is responsible for guarding people placed under threat.<\/p>\n\n\n\n<p>But a tragedy just 40 kilometers from La Toma has brought them new trouble. In November of 2014, <strong>30 people walked from La Toma to Bogot\u00e1 to ask that the government stop the destruction of the river.<\/strong><\/p>\n\n\n\n<p>One month later, the armed forces destroyed the backhoes. The community\u2019s female leadership became the leading voice, including names such as Francia M\u00e1rquez, Marilin Machado, Alexa Leonor Mina, Sof\u00eda Garz\u00f3n, Yineth Balanta, Marlin Mancilla and Clemencia Fory.&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>&#8220;The gold rush brought many people from all over the country, who for the most part were bad people, and this resulted in many sexual violations&#8221;.<\/p><cite>An\u00edbal Vega<\/cite><\/blockquote>\n\n\n\n<p>In spite of all the efforts, <strong>illegal mining brought the Ovejas basin to the brink of destruction<\/strong>. The fierce attack of the illegal miners with heavy machinery damaged the riverbed in several different places. With the river\u2019s deformation came a tragic aftermath of pools of cyanide and water poisoned with mercury, with even more impacts on the women of the community.&nbsp;<\/p>\n\n\n\n<p>\u201cThe gold rush brought many people from all over the country, who for the most part were bad people, and this resulted in many sexual violations, and <strong>when it came to taking legal action, we didn\u00b4t know who to accuse because we didn\u00b4t know who these people were. There are many mothers, many women in our land who have children and do not know their father<\/strong>,\u201d complains An\u00edbal Vega.<\/p>\n\n\n\n<figure class=\"wp-block-gallery alignfull columns-3 is-cropped wp-block-gallery-1 is-layout-flex wp-block-gallery-is-layout-flex\"><ul class=\"blocks-gallery-grid\"><li class=\"blocks-gallery-item\"><figure><img loading=\"lazy\" and they presume that many women opted to remain silent about their abuse.<\/p>\n\n\n\n<p>With the destruction of the backhoe machinery in the Ovejas River there also came the death threats again Francia M\u00e1rquez and her children, proffered by criminal groups who wanted to be paid the the value of the incinerated machinery. <strong>Francia was forced to leave in January 2015.<\/strong><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>&#8220;all of my companions are there in the community, but I am the one who cannot return, and I was the one who had to escape with my children&#8221;.<\/p><cite>Francia M\u00e1rquez<\/cite><\/blockquote>\n\n\n\n<p>\u201c<strong>When you are a woman and you are take on these sort of fights, they see you as weaker and they can get to you easier<\/strong>. A prime example of this is my situation: all of my companions are there in the community, but I am the one who cannot return, and I was the one who had to escape with my children. <strong>I\u00b4m the one who hasn\u00b4t been able to return because I have no guarantees<\/strong>,\u201d affirms M\u00e1rquez, who also received the National Prize for <a href=\"https:\/\/lasillavacia.com\/users\/francia-marquez\">Human Rights<\/a> from the NGO Diakonia Catholic and the Swedish Catholic Church after the Women\u00b4s March.<\/p>\n\n\n\n<div council of La Toma is convinced that <strong>the battles they have had to fight have been promoted by a state which, instead of legally recognizing their territory and their collective rights such as prior consultation, chose to ignore them and gave up their lands to various parties who came after the gold in La Toma\u00b4s soil.<\/strong><\/p>\n\n\n\n<p>According to an answer from the Autonomous Regional Corporation of Cauca (CRC), the maximum authority on environmental matters in the region, the answer a freedom of information request sent for this story stated that tens of exploration and exploitation permits were granted to individuals such as Alonso Giraldo, Miguel Antonio Carabal\u00ed, Eusebio Lucum\u00ed and&nbsp; Ra\u00fal Fernando Ruiz.<\/p>\n\n\n\n<figure href=\"https:\/\/lasillavacia.com\/historia\/cosigo-la-punta-de-lanza-de-la-mineria-en-la-amazonia-45459\">lawsuit<\/a> in the Amazon rainforest and to whose legal representative in Colombia and Brazil, Andr\u00e9s Rendle, was granted a mining license in Cauca in 2007.<\/p>\n\n\n\n<p><strong>A <a href=\"https:\/\/lasillavacia.com\/queridodiario\/la-corte-falla-contra-minera-que-queria-tumbar-el-parque-amazonico-51325\">historic ruling<\/a> by the Constitutional Court in September 2015 stopped Cosigo Resources from exploiting gold in the area they had been granted, inside the Yaigoj\u00e9-Apaporis National Park in the heart of the Amazon. <\/strong>The mining title had been granted by the government of \u00c1lvaro Uribe after the creation of protected areas and it went against the constitutional prohibition of mining within national parks.<\/p>\n\n\n\n<figure class=\"wp-block-image alignfull size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"2560\" height=\"1707\" src=\"https:\/\/tierra.jerre-dev.xyz\/wp-content\/uploads\/2020\/03\/20-scaled.jpg\" alt=\"\" the main worries in La Toma now came from the granting of a permission by the former Ingeominas <\/strong>(whose work in granting titles was inherited by the current National Mining Agency) to H\u00e9ctor Jes\u00fas Sarria, a person unknown to the local people, for extraction of gold in an area totaling 99 hectares in the sector of La Carolina for 10 years, beginning in March 2006 and extendable to 2026.&nbsp;&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>This backing meant that Sarria would not have to carry out the the process of the prior consultation that the Colombian Constitution and Convention 169<\/p><\/blockquote>\n\n\n\n<p><strong>In a Ministry of the Interior report from June 2009, a certificate was issued to endorse the BFC-021 project, indicating that there was no Afro-Colombian population within an 18-kilometer perimeter.<\/strong> This backing meant that Sarria would not have to carry out the the process of the prior consultation that the Colombian Constitution and Convention 169 of the International Organization of Work of the United Nations, which Colombia signed, both demand.<\/p>\n\n\n\n<p>After the community of La Toma blocked his entry, Sarria solicited an administrative protection requesting the removal of the Afro-Colombian communities from the territory. <strong>This protection was conceded in April 2009, and in March 2010, the Court of the First Administrative Circuit of Popay\u00e1n ordered the eviction of the Afro-Colombian communities.<\/strong><\/p>\n\n\n\n<figure><iframe loading=\"lazy\" width=\"480\" height=\"270\" src=\"https:\/\/www.youtube.com\/embed\/JBU40Sl5zyY?feature=oembed\" allowfullscreen=\"\"><\/iframe><\/figure>\n\n\n\n<p>\u201cWhen I learned they were going to remove us, I decided to study law. <strong>I had no money for transport or to pay for university, but I reminded myself that for our ancestors things hadn\u00b4t been easy either, and thanks to them we are not in shackles today<\/strong>\u201d, points out M\u00e1rquez, who, after 30 years of running freely between mountains and rivers, conducts this interview in a small apartment that serves as a refuge from the threats against her.<\/p>\n\n\n\n<p><strong>By her second semester of law she knew which fundamental rights they could use to legally defend themselves, and the prior consultation was one of them.<\/strong> With her companions Gabino Hern\u00e1ndez and Yair Ortiz she prepared a guardianship action that was presented in May 2010 before the Superior Tribunal of Popay\u00e1n, <strong>arguing that a violation of rights, rights to dignified living, the terms of the prior consultation, due process, autonomy and cultural integrity.<\/strong><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>&#8220;When I learned they were going to remove us, I decided to study law&#8221;<\/p><cite>Francia M\u00e1rquez<\/cite><\/blockquote>\n\n\n\n<p><strong>The legal petition was rejected in the first instance because La Toma was supposedly not a black community with a collective title<\/strong>, and thus was ratified in the second instance by the Supreme Court of Justice. The community did not give up, and solicited a revision by the national Constitutional Court.<\/p>\n\n\n\n<p>On the 14th December, <strong>the highest court of Colombia\u2019s justice system revoked the decision and <a href=\"http:\/\/www.corteconstitucional.gov.co\/relatoria\/2010\/t-1045a-10.htm\">recognized<\/a> the fundamental rights of the Afro-Colombian community of La Toma to prior consultation and due process.<\/strong> Amongst other things, the court ordered that Ingeominas, \u201crefrain from granting, or suspend, as the case may be, the licences for mining exploitation in the project of Mr. H\u00e9ctor Jes\u00fas Sarria or any other in the hamlet of La Toma of Su\u00e1rez, Cauca, until the prior consultation ordered in this ruling is carried out in a proper manner and the respective environmental license is issued legally and if applicable.\u201d<\/p>\n\n\n\n<figure><iframe loading=\"lazy\" src=\"https:\/\/cdn.knightlab.com\/libs\/timeline3\/latest\/embed\/index.html?source=15ifpZYj03NBvOC2R39v_92Gdt7U1ZuFE30kZ61xQ4Oc&#038;font=Default&#038;lang=es&#038;timenav_position=top&#038;initial_zoom=0&#038;height=400\" width=\"100%\" height=\"400\" allowfullscreen=\"\"><\/iframe><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The fight goes on<\/strong><\/h2>\n\n\n\n<p>The La Toma community did not drop their guard and remained alert to the possibility of any legal or illegal attempt to destroy their land and their water. <strong>What currently propels them is asserting their legal rights and carrying out a prior consultation that could allow and environmental management plan on the Salvajina Reservoir.<\/strong><\/p>\n\n\n\n<p>\u201cThirty-five years have passed since the building of the reservoir and there is still no environmental management plan. <strong>Something serious could happen here with this wall and it would take out everything there is below, because there is also no contingency plan.<\/strong> Recently, EPSA started to make an imitation environmental management plan not taking into account the advice of the community council nor the indigenous guards,\u201d says Marilyn Machado, a member of the community council.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>&#8220;Thirty-five years have passed since the building of the reservoir and there is still no environmental management plan&#8221;.<\/p><cite>Marilyn Machado<\/cite><\/blockquote>\n\n\n\n<p>EPSA was created in 1995, complying with the order in <strong><a class=\"rank-math-link\" href=\"http:\/\/www.secretariasenado.gov.co\/senado\/basedoc\/ley_0099_1993.html\">Law 99 of 1993<\/a> which required the separation of environmental regulation and businesses such as those which generate electric energy.&nbsp;<\/strong> The Salvajina was then property of the Autonomous Regional Corporation of Valle de Cauca (CVC), a regional environmental authority, and was administered by the company Colinversiones.<\/p>\n\n\n\n<figure class=\"wp-block-image alignfull size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"2560\" height=\"1707\" Dentro de los logros obtenidos recientemente en el periodismo, figuran el premio del C\u00edrculo de Periodistas de Bogot\u00e1 (CPB) en el 2016 y \u2018Menci\u00f3n Especial\u2019 en el Premio Internacional de Periodismo Medioambiental Befesa, en Huelva (Espa\u00f1a). Tambi\u00e9n ha ganado en tres oportunidades el Premio Nacional de Periodismos Sim\u00f3n Bol\u00edvar, incluido el reconocimiento a Periodista del A\u00f1o en el 2016. En el 2017 gan\u00f3 el Premio Gabo por un reportaje sobre el mapa de la muerte en Cali y en el 2018 recibi\u00f3 el reconocimiento de la Conferencia Latinoamericana de Periodismo de Investigaci\u00f3n (Colp\u00edn).
